Have you suffered an injury due to a slip, a trip or a fall?
If you have had a fall in a public place such as a cinema or in the street and this is caused for example by a hole in the floor or ground, a wet floor you may have a claim against the person or group responsible for the upkeep and maintenance of the area.
To make a claim you must have been injured in the last three years and the accident must have been someone else's fault.
How accidents can occur
- Roads or pavements. Your local council are legally bound to maintain the roads and pavements to a reasonable standard.
- Shops. Shopkeepers have a legal duty to ensure the safety of their customers whilst on their premises, including the car park.
What you should do
- Details of the road name where the incident occurred.
- Details of any witness to the incident.
- Take a photograph of the defect that caused the incident, with something to show a scale – such as a ruler, a coin or an object of a fixed size, or a make a plan of the accident site.
